The Moscow Arbitration Court (Russia) recorded the statement of Alla Pugacheva claim to Rospatent to invalidate agency action on Nov. 6, 2009 for early termination of the legal protection of "Philipp", which belongs Pugacheva. Authorities decision to suspend legal protection relates to the goods and services from ICGS 41 class - education, providing of training, entertainment, sporting and cultural activities. Currently, Alla Pugacheva is the holder of the verbal trademark "Philipp" in the twenty classes of the Nice Classification. Pugacheva may use the trademark "Philipp" in the production of these goods and services: Bleaching preparations and other substances for laundry, pharmaceutical, veterinary and sanitary preparations, devices for recording, vehicles, furniture, mirrors, frames, tea, rice, tapioca, sago, honey, treacle syrup, yeast, baking powder, salt, mustard, vinegar, sauces (condiments), spices, transport, packing and storage of goods, organization of travel. Earlier Pugacheva owns the rights to Philip on the 41-th class of ICGS too. According to RIA Novosti, last year Rospatent has request from ANOO "Philipp" (a company registered in Samara) for termination of legal protection for the mark "Philipp" in relation to goods and services from p.41 of the International Classification of Goods and Services (ICGS) in connection with its disuse in this category. After reviewing the case materials, the Rospatent Chamber of Patent Disputes decided to approve the application of Samara ANOO "Philipp" and deprived Pugacheva trademark rights of "Philipp" in the 41 class of ICGS. In the other classes of legal protection under the certificate, issued to Pugacheva, remains in force. But now Pugacheva decided that she needs patent for "Philipp" in 41 class of ICGS too.
