Chinese search engine Baidu has won a lawsuit with Western labels

2010-01-26

1st Beijing Intermediate People's Court took the search engine charges of condoning piracy. The suit was filed by record labels Universal Music, Sony BMG Music Entertainment Hong Kong and Warner Music Hong Kong in early 2008. Labels accused Baidu that the system shows a search results link to sites hosting the pirated songs.

However, the court did not consider the search engine illegal actions.

A similar complaint was filed by the same labels, as well as by Gold Label Entertainment on Chinese portal Sohu.Com and search engine Sogou. Again, the court found that the defendants did not violate the laws, giving links to resources with illegal tracks.

Representatives of the International Federation of the Phonographic Industry (IFPI) are disappointed by both decisions, but intend to continue the fight. According to them, a business search engine based on the promotion of large-scale copyright infringement, causing material damage to artists, producers and all the players of legal music market in China.
