File-sharing is not copyright infringement if used for personal non-commercial purposes.

This decision ended litigation between the Spanish organization for the protection of the rights of authors and publishers SGAE and the owner of a local file-sharing network elrincondejesus.com. Copyright Defenders wanted so the resource must be closed. A complaint to the owner of resource Jesus Herre organization filled in May last year, noting the document that elrincondejesus violates the rights of several owners.

In SGAE hoped that the resource will be closed before the end of the trial. The court, however, last summer found that it is unjustified measure. The judge said that peer networks - is just a way to exchange data between users, and no copyright simply by default, by its very existence, they can not interfere.

The judge has not changed his point of view when makes final decision. He checked the financial statements of the owner peer network, if it satisfied that the defendant did not earn on providing users the ability to exchange links. It was therefore decided that the very posting links to files that are protected by copyright are not a violation if no one does not earn.
